HR 2599 Gains Strong Bipartisan Support
Introduced on July 20th, The PACE Assessment Protection Act of 2011 (HR 2599) has been co-sponsored by 14 Republicans and 11 Democrats from around the Country… impressive considering that the deliberations over the debt ceiling that consumed Congress before the August recess. Rule do not permit members to add their names as co-sponsors while Congress is not in session, so look for an increase as soon as they return in September. HR 2599 was introduced by Congresswoman Nan Hayworth (R-NY) and Congressmen Dan Lungren (R-CA) and Mike Thompson (D-CA). The work of getting more co-sponsors continues and you can help. Federal District Court for the Northern District of California issued a ruling on August 26, 2011 that requires the FHFA to conduct a rulemaking procedure, while keeping in place its July 6, 2010 statement. The Court rejected the FHFA’s claim that it had acted in its conservator role, which would have precluded judicial review. The rulemaking process from the FHFA’s website can be found here….. The text of the Court’s ruling can be found here.
You can use this opportunity to file comments that the FHFA will be required to address. Details will be forthcoming. Summary of the process is below.
- Proposed Rules will be published in the Federal Register.
- Public Comment is invited for a period of from 30 to 180 days.
- Final Rule. the agency publishes its response to issues raised by public comments and an updated analysis and justification for the rule, including an analysis of any new information from public comments.
If the Court acts on its December 20, 2010 order and concludes the FHFA should conduct a rulemaking process, you can help save PACE by submitting comments to the FHFA that address points it made when it established its July 6, 2010 rules.
